Title 49 › Subtitle SUBTITLE III— GENERAL AND INTERMODAL PROGRAMS › Chapter 51— TRANSPORTATION OF HAZARDOUS MATERIAL › § 5127
If the Secretary’s final action harms you, you can ask a Court of Appeals to review it. You must file a petition within 60 days in the D.C. circuit or the appeals circuit where you or your business is. When filed, the court sends the petition to the Secretary, who files the record. The appeals court can uphold or overturn the action, order more proceedings, and will only consider objections raised earlier or if there was a good reason they were not.
