Title 49 › SUBTITLE VIII — PIPELINES › CHAPTER 601 — SAFETY › § 60131
Pipeline operators must create and use a worker qualification program so people who do “covered tasks” are actually trained and tested to do them safely. The program must be written and include ways to test or check workers (like written tests, oral tests, on-the-job observation, simulations, or training), regular rechecks, training if needed, and written records of any observations. Operators must have their plans reviewed and verified by the Secretary of Transportation (or the State agency for intrastate pipelines). If an operator changes a verified program a lot, the operator must tell the Secretary and get the changes reviewed. The Secretary can require fixes if a program is unsafe and can waive or change rules under section 60118(c). The Department of Transportation must put standards in place within 1 year. Each operator must adopt a program that meets those standards within 2 years and finish qualifying all needed workers within 18 months after adopting the program. The Secretary must review and verify operator programs within 3 years and send Congress a report on the rules’ status within 4 years. “Covered task” means the tasks defined in 49 C.F.R. 192.801 for gas or 49 C.F.R. 195.501 for hazardous liquid pipelines.
