States must apply to the Secretary to get a grant under section 6106. The application must be sent no later than 2 years after this chapter was enacted. The Secretary will review the State’s one-call program, how it is run, and its enforcement record. The Secretary will decide if the program meets the minimum standards in section 6103 to qualify for the grant. The Secretary may work with a State to see if its current program, a change, or a proposed program would meet the standards faster. The Secretary will set the application form and what information is needed. The application and the Secretary’s actions will be open to the public. A State can also get a grant if it has an alternate one-call program that gives equal or better protection for public safety, people who dig, and the environment than a program that meets section 6103. The Secretary must report (under section 60124) on each State, including whether it adopted the minimum standards or has an alternative, how well the program works, how required participation affects prevention of damage to underground facilities, and what needs improvement.
