The Special Counsel must publish lists and reports about certain matters sent to agency heads under sections 1213(c), 1215(c)(2), and 1214(e) (with agency certifications), and must publish reports sent under 1213(g)(1). For matters sent under 1213(c), the Special Counsel must include the material sent to the agency, the agency’s report, any complainant comments if the law allows and the complainant agrees, and the Special Counsel’s own comments or recommendations under 1213(e)(3) or (e)(4). Before making anything public, the Special Counsel must make sure the release does not include information that law or an Executive order says must stay secret for national defense or foreign affairs.
