The Director must lead and coordinate ethics and conflict-of-interest rules for executive branch agencies, working with the Office of Personnel Management and the Attorney General when needed. The Director has 15 main duties, including creating rules about conflicts and financial disclosures; monitoring and investigating whether officers and employees follow disclosure rules; reviewing filings for possible conflicts and recommending fixes; interpreting rules and advising agency ethics officials; running a public advisory-opinion service and publishing opinions; requiring agencies to have written procedures for collecting and handling financial disclosures; asking agencies for reports and receiving annual reports that describe agency ethics programs and name the officials in charge; and promoting ethics training. The Director also helps the Attorney General evaluate the laws and improve reporting systems as required by section 535 of title 28. The Director can order agencies to fix their disclosure systems or change their ethics programs and can order employees to take steps (for example, sell assets, recuse from matters, or set up a blind trust) to stop conflicts. The Director may recommend investigations or disciplinary action and can investigate possible violations. Before making most findings or ordering action, the Director must notify the person involved and allow them to comment and, if requested, have a hearing on the record, except that different procedures apply for enforcement of financial disclosure rules under section 13108. If an agency does not follow a Director’s order, the Director must notify the President and Congress. The Director may not make criminal findings. Records of individual investigations are not released under section 552(a)(3) of this title unless the requester names the individual and the subject of the alleged violation; the normal exemptions of section 552(b) still apply.
