Title 5 › Part III— EMPLOYEES › Subpart B— Employment and Retention › Chapter 35— RETENTION PREFERENCE, VOLUNTARY SEPARATION INCENTIVE PAYMENTS, RESTORATION, AND REEMPLOYMENT › Subchapter VII— RETENTION OF RETIRED SPECIALIZED EMPLOYEES AT THE FEDERAL BUREAU OF INVESTIGATION › § 3598
The FBI director can create and train an FBI Reserve Service to bring back former full-time FBI employees for temporary work during emergencies the director decides are happening. Only people who once worked full time for the FBI can join. The Reserve can have no more than 500 members at any time. If someone getting a pension from the Civil Service Retirement and Disability Fund is temporarily rehired through the Reserve, their pension keeps being paid and they are not treated as an employee under chapters 83 or 84. Reserve members rehired temporarily do not count against any FBI staffing limits. The director may pay travel and daily allowances for Reserve training under the applicable rules. No one may be rehired under this rule for more than 180 days for the same emergency unless the director finds it is in the public interest to continue.
