Each year, every agency must send the Office a list of career appointees it recommends for the Meritorious Executive or Distinguished Executive ranks. Agencies may consider performance over several years. The Office reviews those lists and advises the President, who may give ranks during the fiscal year. No more than 5% of the Senior Executive Service may be Meritorious and no more than 1% may be Distinguished in any year. A Meritorious rank gives a one-time payment equal to 20% of annual basic pay. A Distinguished rank gives a one-time payment equal to 35% of annual basic pay. These payments are in addition to regular pay and other awards. "Agency," "senior executive," and "career appointee" are defined in section 3132(a).
