Title 5 › Part III— EMPLOYEES › Subpart D— Pay and Allowances › Chapter 57— TRAVEL, TRANSPORTATION, AND SUBSISTENCE › Subchapter IV— MISCELLANEOUS PROVISIONS › § 5751
Under rules the Attorney General makes, a federal employee (see section 2105), except someone paid by the Secretary of the Senate or the Chief Administrative Officer of the House, who is summoned or sent to testify or to give official records for the United States gets travel expenses under subchapter I. If the matter is part of their job, the agency pays from its travel funds with proper agency certification. If it is not part of the agency’s work, the agency may pay first and then get reimbursed by the agency that should cover the cost. If the employee is asked to testify or provide records for a party other than the United States, they still get travel expenses under subchapter I unless the court, authority, or party that summoned them already paid those expenses.
