OPM can let an agency give a supervisory pay boost to a General Schedule (GS) worker who supervises one or more non‑GS employees when a subordinate would otherwise earn more than the supervisor. When comparing pay, extra pay like comparability payments, other differentials, and non‑basic allowances can be counted under OPM rules. The boost may be a percent of the supervisor’s basic pay (not counting comparability payments) or a flat dollar amount, but it cannot make the supervisor earn more than 3% above the highest paid subordinate. The boost is paid with the regular pay, is not part of basic pay, and a cut or removal cannot be appealed, though rights under subchapter II of chapter 12 and section 2302(d) stay. "Agency" and "employee" use the meanings in section 5102. "Employee under the General Schedule" means positions covered by subchapter III of chapter 53. OPM will write rules to run this program.
