Title 5 › PART III — EMPLOYEES › Subpart D — Pay and Allowances › CHAPTER 59 — ALLOWANCES › SUBCHAPTER IV — MISCELLANEOUS ALLOWANCES › § 5943
The President can pay civilian employees and members of the uniformed services for losses they suffer while serving in a foreign country when foreign money gains value against the U.S. dollar. Those payments are not subject to income tax. Congress can provide yearly money to make these payments and to cover any deficit in the Treasury’s accounts, including interest, tied to the July 27, 1933 arrangement that converted employees’ and service members’ checks and drafts into foreign currency. If a person’s pay was converted under that arrangement for a given period, they cannot also get a payment for that same period. The President must report each year to Congress all payments made.
