Agencies must publish a regulatory flexibility agenda in the Federal Register every October and April. The agenda must list rules the agency expects to propose or create that could affect many small entities. For each item it must give a short description, the rule’s goals and legal basis, an estimated timetable if a general notice of proposed rulemaking exists, and a contact name and phone number. Agencies must send the agenda to the Chief Counsel for Advocacy at the Small Business Administration for comment, try to notify small entities or their representatives and invite comments, and may act on matters whether or not they appear on the agenda.
