Title 5 › Part III— EMPLOYEES › Subpart E— Attendance and Leave › Chapter 61— HOURS OF WORK › Subchapter II— FLEXIBLE AND COMPRESSED WORK SCHEDULES › § 6128
Hours that are part of a compressed work schedule are not counted under the usual overtime laws. If a full-time worker works more hours than their compressed schedule, those extra hours are overtime and paid under the normal overtime rules. A part-time worker on a similar compressed schedule starts getting overtime after the same number of hours that would trigger overtime for a full-time worker on that schedule. If a full-time worker on a compressed schedule works a shift that includes any Sunday, they get their regular pay plus a 25% premium for the whole shift (for non‑overtime hours). If they work on a federal holiday, they get regular pay plus a premium equal to their regular pay for hours up to their basic work requirement that day. Holiday hours beyond the basic requirement are paid as overtime under the usual rules, using whichever rule gives the worker the better pay.
