An employee may ask to get donated leave from their agency’s leave bank. The request must go to the agency’s Leave Bank Board and must name the person, give their job and pay level, explain why leave is needed (what the medical problem is, how serious it is, how long it will last, and how often it comes back if it does), include doctors’ or experts’ notes if the Board asks, and give any other reasonable information the Board wants. The Leave Bank Board can approve the request. Donated annual leave can be used like regular annual leave under section 6303, but the employee must use their own annual and sick leave first. Donated leave can keep accumulating beyond the usual limit under section 6304 and can be applied retroactively to cover unpaid leave or repay advanced leave starting on an agency-set date for the medical emergency. Section 7351 does not apply to asking for, giving, or using leave in a leave bank unless the Office of Personnel Management makes rules.
