The Director of the Office of Personnel Management must, after giving notice and a chance for a hearing, give any employee found to have broken section 9202 a written warning that explains the misconduct and possible future penalties, and must put that warning in the employee’s official personnel file. If the employee breaks the rule again and the Director, after notice and a hearing, finds a new violation, the Director may suspend the employee and, for later offenses, add fines: a second violation may bring a suspension up to 7 days; a third violation a suspension of more than 7 days; a fourth a suspension of more than 7 days and a fine up to $250; a fifth a suspension of more than 7 days and a fine up to $500; any later violation a suspension of more than 7 days and a fine up to $1,000.
