The IRS can set some Senior Executive Service (SES) jobs so only certain people can hold them. Those jobs must go to either a career appointee, or to a limited emergency or limited term appointee who was already serving under a career or career-conditional job outside the SES when they moved in, or whose limited appointment was approved beforehand by the Office of Personnel Management (OPM). No more than 10 percent of IRS SES jobs may be filled by those limited appointees. A limited appointee’s term can be up to 3 years. They may serve two such terms, and they may serve two terms plus any unexpired term they had when appointed.
