Title 50 › CHAPTER 51 — WAR CLAIMS › SUBCHAPTER I — TITLE I OF WAR CLAIMS ACT OF 1948 › § 4105
Lets the federal War Claims Commission take, decide, and pay money for claims by U.S. service members who were held as prisoners of war after certain dates. For people held after December 7, 1941, the Commission can pay $1 for each day the enemy failed to give the food required by the 1929 Geneva Convention. For other violations after that same date—like forced labor rules or certain kinds of cruel or inhumane treatment—the Commission can pay $1.50 per day, up to $1.50 for any single day. For the Korean War period (held after June 25, 1950, and before August 21, 1954, and also for a person from the U.S.S. Pueblo captured January 23, 1968, and held through December 23, 1968), the Commission can pay $1 per day for missing food and $1.50 per day for labor violations or inhumane treatment. For the Vietnam conflict (from February 28, 1961, until a date set later by the President or Congress), the Commission can pay $2 per day for missing food under the 1949 Geneva Convention and $3 per day for labor violations or inhumane treatment, up to $3 for any single day. “Inhumane treatment” covers violations of many specific Geneva rules listed in the law. Approved claims are sent to the Secretary of the Treasury and paid from the War Claims Fund or other money authorized by Congress. Payments go to the claimant, or if the claimant is dead, to relatives in this order: spouse (if no children), spouse and children split half/half, children equally (if no spouse), or parents equally (if no spouse or children). For Korean War claims, you must file within one year from the latest of certain dates listed in the law; for Vietnam claims, you must file within three years from the latest of certain dates. The Commission must finish its decision on each Korean or Vietnam claim no later than one year after the claim was filed. If a person is legally unable to receive payment, other payment rules apply.
