Projects chosen under this chapter must protect and improve the nation’s natural resources and environmental quality. The Transportation Secretary must talk with the Interior Secretary and the EPA about any project that could seriously affect wildlife, scenic or recreational areas, water, air, or other environmental features. If the Transportation Secretary decides a project will cause major harm, the project can only be approved after a full public-record review and a written decision that no practical alternative exists and that all reasonable steps were taken to reduce the harm. The Transportation Secretary can approve a project only if the project sponsor says a public hearing was offered about the project’s economic, social, and environmental effects and how it fits local plans, and the sponsor gives a hearing transcript if one was held. The State’s chief executive must certify in writing that the project will meet air and water quality standards, or the EPA Administrator must do so if those standards are not set; that certification or refusal must come within 60 days after the Secretary gets the application. Approval must require following air and water rules during construction and operation. The Secretary can also require sponsors to certify they will follow all laws and can withdraw acceptance of such certifications. This does not change the Secretary’s duties under other laws, including section 303 of title 49; title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.); title VIII of the Act of April 11, 1968 (42 U.S.C. 3601 et seq.); the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42 U.S.C. 4601 et seq.).
