The Attorney General can sue in federal court if the Secretary finds that a System unit resource was damaged, lost, or harmed, or would have been without a response. The Secretary must ask the Attorney General to bring the suit whenever a person or instrumentality may be legally responsible for cleanup costs and damages. The Secretary must take whatever actions are needed to prevent or reduce harm to System unit resources, or to lower any immediate risk of harm. The Secretary must also check and keep track of any damage, loss, or harm to those resources.
