The Secretary may award and run commercial contracts to operate or expand visitor facilities and services in System units. Contracts must serve the public and protect the unit’s natural and cultural resources. Most federal procurement rules do not apply to these contracts, but laws about worker conditions, wages, and civil rights still do — including the Alaska National Interest Lands Conservation Act (16 U.S.C. 3101 et seq.) and the Davis‑Bacon Act (40 U.S.C. 3141–3144, 3146, 3147). Contracts must expand, modernize, or improve facilities and services. They cannot cover outfitter and guide services in section 101913(8) or services where a concessioner has a preferential renewal right under sections 101911 and 101913.
