States running an approved program under chapter 3023 must send the Secretary nominations for places that meet the rules in section 302103. If the Secretary gets a complete nomination and the needed papers, the place is added to the National Register 45 days later unless the Secretary rejects it within those 45 days or someone files an appeal under subsection (d). If a State has no approved program, the Secretary can accept nominations from people or local governments and must decide within 90 days unless appealed under subsection (d). Federal agencies can nominate directly only after following steps: give the nomination to the State Historic Preservation Officer for review (who has 45 days to respond), notify local officials (45 days to comment), have the Federal Preservation Officer forward a complete, professional nomination to the Keeper, publish notice and the SHPO’s comments in the Federal Register, and address any SHPO objections there before listing. Any person or local government may appeal a nomination or a failure to nominate to the Secretary under subsection (d).
