§302504 Participation of Certified Local Governments in National Register Nominations

Title 54 › Subtitle Subtitle III— National Preservation Programs › Chapter 3025— CERTIFICATION OF LOCAL GOVERNMENTS › § 302504

Last updated Apr 5, 2026|Official source

Summary

Before a property in a certified local government can be sent to the Secretary for the National Register, the State Historic Preservation Officer must tell the property owner, the top local elected official, and the local historic preservation commission. The local commission must give people a chance to comment and then write a short report on whether the property meets the National Register rules. Within 60 days of the State’s notice, the top local official must send the commission’s report and the local recommendation back to the State Historic Preservation Officer. After the State gets the report, or if no report arrives within 60 days, the State will go ahead with the nomination under section 302104. The State can speed this up if the certified local government agrees. If both the commission and the top local official say “do not nominate,” the State stops unless an appeal is filed within 30 days of the State receiving that recommendation. If appealed, the State follows the normal nomination steps. Any local reports and recommendations must be included with the nomination the State sends to the Secretary.
