People who must get a security credential or a background check can meet that rule by getting and keeping a valid transportation security card. The Department of Homeland Security must let those people apply for that card and can charge reasonable fees for the checks. The agency in charge will also use the FBI’s Rap Back Service and other vetting tools, including No‑Fly and Selectee lists, to get immediate notice if someone with a valid card has new criminal activity. The law uses two special terms: an “applicable individual” — a worker regulated by TSA, DOT, or the Coast Guard who needs a background check for certain jobs; and a “valid transportation security card” — a current, untampered card with the person’s photo issued under the transportation security program.
