Defines key words used in this part of the law. Many cybersecurity terms (cybersecurity purpose, cybersecurity threat, cyber threat indicator, defensive measure, information system, malicious cyber command and control, malicious reconnaissance, monitor, security control, and security vulnerability) are defined elsewhere in the law (see section 650). Agency means what “agency” means in title 44, section 3502. Antitrust laws refers to the definition in title 15, section 12, includes section 45 when it covers unfair competition, and can include state antitrust laws only if they agree with the federal rules. Appropriate Federal entities names seven federal departments or offices: Commerce; Defense; Energy; Homeland Security; Justice; Treasury; and the Office of the Director of National Intelligence. Federal entity means any U.S. department, agency, or part of one. Local government means a city, county, town, village, parish, township, borough, or similar part of a state. Non-Federal entity means private groups or any state, tribal, territorial, or local government or their agencies (including DC, Puerto Rico, U.S. Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, and other U.S. territories), but not a foreign power as defined in title 50, section 1801. Private entity means a person or private organization (including nonprofits and businesses), and also includes state/tribal/local governments that provide utility services; it does not include a foreign power. Tribal means “Indian tribe” as defined in title 25, section 5304.
