Anyone can apply to the Administrator for permission to use a pesticide experimentally. The Administrator must review the application and, after getting all required data, either grant the permit or say why not within 120 days (or, for certain covered applications under section 136w–8(b), by the deadline in that section). The applicant has 30 days to fix problems or ask for a waiver. The Administrator may only grant a permit if the applicant needs it to gather information needed to register the pesticide under section 136a. Applications can be filed at any time. If the pesticide might leave residue on food or feed, the Administrator can set a temporary residue limit before issuing the permit. The Administrator supervises the use and can set terms, conditions, and time limits. For a pesticide with a new chemical, the Administrator can require environmental studies and must get their results before registration under section 136a. The Administrator can revoke a permit for violations or if it won’t prevent harm. The Administrator may let States issue permits under rules and may issue one-year (or other time-limited) permits to public or private agricultural research agencies or schools for experimental use only.
