The Secretary can hire the staff needed to run the programs in sections 171 to 173, including non‑U.S. citizens, and these hires can be made outside normal civil‑service rules. Sections 321, 322, 324, and 325a of title 40 do not apply to nursery, planting, cultivating, or harvesting work done under sections 171–173. All hires must be based only on ability and performance. The Secretary can give powers or duties to any USDA agency or office, and with agreement from other government boards, commissions, corporations, or departments, can use their information, services, facilities, and people. The Secretary may also allocate or transfer funds to USDA units or to state and federal agencies that help, and has the powers in section 502 of title 16. The Secretary may lease government buildings with needed facilities for as long as they are not required for these programs, and may lease or sublease land or buildings acquired for the programs if not needed. Surplus water controlled by the United States on land owned or leased for these purposes may be sold or otherwise provided at reasonable rates.
