Title 7 › CHAPTER 1 — COMMODITY EXCHANGES › § 26
The law pays people who blow the whistle 10% to 30% of money collected in big enforcement cases when their original tip helped the Commodity Futures Trading Commission (the Commission) win the case or reach a settlement. A “covered” case is one where the monetary penalties collected are more than $1,000,000. “Monetary sanctions” include penalties, disgorgement, restitution, interest, and similar funds. “Original information” means the tip came from the whistleblower’s own knowledge or analysis, was not already known to the Commission, and was not just taken from public sources unless the whistleblower was the original source. Awards are paid from the Commodity Futures Trading Commission Customer Protection Fund. The Commission decides who gets an award and how much, using rules that look at how important the tip was, how much help the whistleblower gave, and the goal of stopping violations. People who work for certain government or regulated entities, or who commit related crimes, can be denied awards. Whistleblowers may have a lawyer; anonymous claims must use a lawyer and the whistleblower must reveal their identity before payment. Employers may not fire or punish whistleblowers for cooperating, and victims can sue within 2 years for reinstatement, back pay, and other damages. The Fund, kept in the U.S. Treasury, pays awards and funds customer education. Collected sanctions go into the Fund unless victims get the money or the Fund already has more than $100,000,000. The Commission can share whistleblower information with certain government and regulatory bodies while keeping it confidential, and false statements by a whistleblower can lead to prosecution under 18 U.S.C. 1001. Rights under other laws remain, and employers cannot force whistleblowers to give up these rights or make them use predispute arbitration.
