Federal money under this part cannot be given to a State or Territory to support a college that uses race or color to decide who may enter. Having separate colleges for white and colored students is allowed only if the federal funds for that State are fairly split and paid out as required. If a State already has one college under subchapter I and also had, on August 30, 1890, a state-aided school for colored students in agriculture and mechanic arts, the State legislature may propose a fair division of the funds between the white college and the colored institution. Once split and paid, the colored institution gets the same benefits and must follow the same rules as if it had been included under subchapter I.
