§4308 Referendum; Necessity, Etc.

Summary

The Secretary must hold a vote of domestic growers and importers (except those exempt under section 4311) who handled flowers and plants during a time period the Secretary chooses. An order only goes into effect if at least two-thirds of those voting approve it, or if a majority approve and that majority produced or imported at least two-thirds of the total value of the flowers and plants voted on during that period. The costs of running the vote must be paid from the industry assessments, but not the salaries of federal employees.
