The Secretary must hold a vote of domestic flower and plant producers and importers who are not exempt and who were producing or importing during a time period the Secretary picks. An order only takes effect if at least two-thirds of those voting approve it, or if a majority approve and that approving majority produced and imported at least two-thirds of the total value of the flowers and plants made and imported by voters during the chosen period. The Secretary’s costs to run the vote must be paid back from fees collected, but government employee salaries are not reimbursed.
