Title 7 › Chapter 89— PECAN PROMOTION AND RESEARCH › § 6003
The Secretary must create and update one national plan that covers pecan growers, grower-shellers, shellers, first handlers, and importers. Only one plan can be in force at any time. The Secretary can propose a plan, or an affected person or growers’ association can ask for one and send a proposal. Within 60 days of a request or of deciding to propose, the Secretary must publish a draft and let the public comment. After reviewing comments, the Secretary must issue a final plan that follows the law’s rules. The final plan must take effect within 150 days of the draft’s publication. The Secretary can later change the plan, and the same rules apply to changes.
