Title 7 › CHAPTER 97 — FRESH CUT FLOWERS AND FRESH CUT GREENS PROMOTION AND INFORMATION › § 6802
Defines key words used for rules about fresh-cut flowers and greens. "Consumer information" means programs that teach people how to use and care for cut flowers and greens. "Cut flowers" are flowers cut from plants and sold fresh, grown in greenhouses or fields. "Cut greens" are decorative foliage cut from plants and sold fresh (not Christmas trees), also from greenhouses or fields. These two do not include potted foliage plants, floral supplies, or flowering plants. If flowers or greens are packed with hard goods (like gift baskets), the PromoFlor Council can decide they are not a big part of the item's value and so not subject to assessments. "Gross sales price" is the total money in a sale from a handler to a retailer or exempt handler. A "qualified handler" sells cut flowers or greens to retailers or exempt handlers and has at least $750,000 in annual sales to them. This can include bouquet makers, certain auction houses, and retailer-owned distribution centers whose main retail activity is floral sales. People who only transport or deliver goods are not qualified handlers. Importers or producers who sell directly to consumers are included if their total sales (counting direct sales as explained below) reach $750,000. An "exempt handler" would be a qualified handler except their sales to retailers and other exempt handlers are under $750,000. Annual sales are usually measured by gross sales price, but non-sale transfers and some direct sales use special formulas that add acquisition price plus a markup or multiply consumer price by a uniform percentage. Changes to those percentages need a PromoFlor Council recommendation and the Secretary’s approval after public notice and comment under section 553 of title 5, without regard to sections 556 and 557. "Order" means an order under this chapter (except sections 6808, 6809, 6811). "Person" covers individuals and business entities. "PromoFlor Council" is the Fresh Cut Flowers and Fresh Cut Greens Promotion Council. "Promotion" means actions to boost image or sales, including paid ads. "Research" means market studies that support promotion and consumer information. "Retailer" is anyone who sells to consumers (like florists, supermarkets, mass retailers) and includes certain distribution centers. "Secretary" means the Secretary of Agriculture. "State" lists the several States, DC, Puerto Rico, the Northern Mariana Islands, U.S. Virgin Islands, Guam, American Samoa, the Marshall Islands, the Federated States of Micronesia, and Palau (until the Compact of Free Association is ratified). "United States" means the States collectively.
