Title 7 › CHAPTER 97 — FRESH CUT FLOWERS AND FRESH CUT GREENS PROMOTION AND INFORMATION › § 6804
Creates a 25-member Fresh Cut Flowers and Fresh Cut Greens Promotion Council to run a national promotion and research program. The Secretary appoints members from nominations. The Council must include 14 qualified wholesale handlers, 3 producer-handlers, 3 importer-handlers, 3 traditional retailers, and 2 producers (one east and one west of the Mississippi). Members serve mostly 3-year terms, with initial staggered terms of 9 for 2 years, 8 for 3 years, and 8 for 4 years. No one may serve more than two back-to-back 3-year terms except a person who first serves a 4-year term and then one 3-year term. Members are not paid but get expense reimbursement. The Council can pick an executive committee of up to 9 members (initially 4 wholesale, 2 producers, 2 importers, 1 retailer) to hire staff and handle routine business. The Council must make rules, hire staff, prepare yearly budgets and promotion or research plans, and send them to the Secretary for approval before using funds. It can run projects itself or contract others, but contracts must include budgets, records, and reports. The Council must keep books, have an annual independent audit, limit administrative costs, and invest funds only in safe instruments listed in the law. Qualified handlers must pay assessments on sales to retailers or exempt handlers. The assessment is 0.5% for the first 3 years. After that the rate can change by up to 0.25% per year but never go above 1%; changes need a two-thirds Council vote, Secretary approval, and 30 days’ notice. Assessments must be paid on a schedule set by the order (no later than 60 days after the month of sale). The Council must create an escrow account with 10% of assessments collected from the order’s start until the initial referendum finishes to allow one-time refund claims if the order is rejected. If the order is approved, no refunds are made and the escrow reverts to the Council. The Council may grant short-term postponements of payments to handlers who prove insolvency with a CPA opinion and meet rules. Funds cannot be used to influence legislation. Handlers must keep and share records as required; most information is kept confidential except in certain legal proceedings. The order must also include other terms needed to run the program, like interest on late payments and importer lists.
