The Secretary can create and run a Farm Service Agency inside the Department of Agriculture. If created, the Agency can take charge of farm price and income support, production adjustment and related programs; certain farm loan and credit programs assigned before October 13, 1994; the programs in Subchapter B of chapter 1 of subtitle D of title XII of the Food Security Act of 1985; and other functions the Secretary thinks fit, except programs the Secretary gives to the Natural Resources Conservation Service or another Department agency. One listed item was repealed on April 4, 1996. When carrying out the programs in the Food Security Act part above, the Secretary must use rules the Farm Service Agency recommends and must get agreement from the Natural Resources Conservation Service (NRCS) at national, State, and local levels. Local NRCS work must involve Soil and Water Conservation Districts or similar groups, and county or area committee officials must meet those districts at least once a year to set local conservation priorities. The Farm Service Agency has first say over appeals of adverse decisions under title XII of the Food Security Act of 1985 until such appeals go to the National Appeals Division. For technical NRCS determinations there must be review rules, the NRCS technical criteria must be used, and relief must be given if a conservation rule would cause undue economic hardship. The Secretary may staff local offices with both Federal employees and non‑Federal committee workers, but any personnel action against a Federal employee must be taken by another Federal employee. The Secretary should also collocate county FSA and NRCS offices to save money, simplify paperwork, improve service, and make computers compatible. References to the Farm Service Agency or the NRCS include any other Department units given the same functions.
