The Commission is the main authority that enforces subtitle A of the Wall Street Transparency and Accountability Act for people and firms, except in the limited situations below. Prudential regulators are the only ones who can enforce section 6s(e) for swap dealers or major swap participants they oversee. If a prudential regulator thinks a swap dealer or major swap participant (or its affiliate or division) may have broken nonprudential rules, it can send the Commission a written report asking the Commission to take enforcement action and explaining the facts. If the Commission thinks such a firm may have broken prudential rules, it can send a written report to the prudential regulator asking that regulator to act and explaining its concerns. If the recipient does not start enforcement within 90 days after getting the report, the sender may start enforcement instead.
