Decisions made by State, county, or area committees (or their employees) for the Farm Service Agency or the Commodity Credit Corporation are covered by this rule, except for actions under section 2008k or for conservation programs run by the Natural Resources Conservation Service. If a covered committee makes a decision in good faith and there was no misrepresentation, false statement, fraud, or intentional wrongdoing, that decision becomes final 90 days after the benefit application is filed unless it is appealed under the law or changed by the FSA Administrator or the CCC Executive Vice President before then. Once a decision is final, the agencies generally cannot recover money paid because of that decision unless the participant had reason to think the decision was wrong. The term Farm Service Agency here also includes any other office given FSA duties under section 6932.
