§7001 Conforming Amendments Relating to National Appeals Division

Summary

Decisions made by State, county, or area committees (or their employees) for Farm Service Agency or Commodity Credit Corporation matters under the authority of a committee set up under section 590h(b)(5) of title 16 become final within 90 days after a person files for benefits. That only applies if the decision was made in good faith and there was no misrepresentation, false statement, fraud, or willful misconduct. It does not apply to work done under section 2008k or to conservation programs run by the Natural Resources Conservation Service. A decision is not final if it is appealed under this subchapter or changed by the FSA Administrator or the CCC Executive Vice President before the 90 days end. If a decision becomes final, the FSA, CCC, or a committee cannot try to get back payments made in error unless the person had reason to think the decision was wrong. References to the Farm Service Agency also include any other Department office given the FSA’s duties under section 6932.
