§7483 Issuance of Orders

Summary

The Secretary must issue one or more orders that apply to popcorn processors to carry out the policy in section 7481(b). The order(s) must cover all popcorn production and marketing areas in the United States, and no more than one order can be in effect at a time. The Secretary must follow the procedure below. The Secretary can start a proposed order, or a processors’ group or anyone who would be affected can ask and send a proposal. Within 60 days of getting a request and proposal (or when the Secretary decides to propose one), a proposed order must be published and opened for public comment. After that comment period, the Secretary must issue a final order that fits the law and must make it effective no later than 150 days after the proposed order was published. The Secretary can amend an order later; the same rules apply to amendments except a referendum is not required for an amendment to take effect.
