§7803 Issuance of Orders

Summary

The Secretary must issue one national order that applies to producers, importers, and first handlers of Hass avocados. Only one such order can be in effect at a time. A state-authorized avocado producer group or anyone who would be affected can ask for and submit a proposed order. The Secretary must publish the proposal and allow public comment; if the request comes from a state group, publication must happen within 60 days of receipt. After comments, the Secretary will issue the order and add needed rules. The order only takes effect after a yes vote in a referendum and must be issued within 180 days of the proposal’s publication. The Secretary may later amend orders, and the same rules apply to amendments.
