Title 7 › CHAPTER 105 — HASS AVOCADO PROMOTION, RESEARCH, AND INFORMATION › § 7804
Creates a Hass Avocado Board of 12 members to run the program. The Board must have seven domestic producers, two importers, and three seats that reflect the ratio of U.S. production to imports based on the Secretary’s 3‑year average. Board members are picked by the Secretary from two nominees for each seat; producers are nominated through state producer organizations and importers by procedures set by the Secretary. Alternates, filling of vacancies, and disqualification if someone no longer represents the group are required. Terms are 3 years, with the first set staggered as four 2‑year, four 3‑year, and four 4‑year appointments. No member may serve more than two consecutive 3‑year terms (a 4‑year initial term may be followed by one 3‑year term). Members do not get pay but are reimbursed for reasonable expenses. The Board must keep books, have an annual independent audit, and make records available to the Secretary. The Board must make budgets and plans for promotion, research, and industry and consumer information and send them to the Secretary for approval; the Secretary must respond within 45 days or the plan is deemed approved. The Board can hire staff, run or contract for programs, handle complaints, invest funds in safe government or bank instruments, borrow startup money, and follow conflict‑of‑interest rules. Assessments start at $0.025 per pound and may change once a year but not above $0.05; changes need at least seven Board votes, Secretary approval, and 30 days’ notice. First handlers collect assessments from producers; importers pay assessments to Customs at entry; payments must be remitted within a time not to exceed 60 days after the month of sale. Export sales are excluded. State producer organizations (and qualifying importers associations) receive 85% of assessments attributable to their members for promotion and research (not for their administrative costs). Administrative costs must not exceed 10% of projected assessments. Funds may not be used to lobby government (except to propose order changes), and programs may not promote private brand names or make false or disparaging claims. The Secretary may be reimbursed up to $25,000 for a referendum and up to two employee‑years annually for supervisory work, plus other implementation and enforcement costs.
