The Secretary must divide a farm’s rice base acres for long grain and medium grain rice using the 4‑year average share of State acreage planted to those rice types during the 2003–2006 crop years to figure counter‑cyclical payments. Producers can instead choose a farm‑level 4‑year average that counts acres actually planted on the farm, acres they could not plant because of drought, flood, or other disasters, and, for years they chose not to plant, the State’s planting shares. The Secretary must keep the total base acres, payment acres, and payment yields for rice as they were under sections 7911 and 7912 on September 30, 2007, unless changed under section 8711.
