Mandatory Notice of Arrival Reporting

If you import pesticides or pesticide devices into the U.S., you must submit a Notice of Arrival (NOA) to EPA prior to the shipment's arrival using EPA Form 3540-1 or its electronic equivalent. The renewal estimates 168,025 potential respondents, a total burden of 67,723 hours per year, and total annual respondent costs of $5,478,039; the reporting requirement is mandatory under 40 CFR 152.25(f), FIFRA sections 3 and 25, and 19 CFR 12.112.

Higher Estimated Burden and Costs

EPA reports an increase in the estimated annual respondent burden by 26,843 hours and an increase in respondent costs by $2,724,517 compared with the current OMB approval. EPA attributes the change to an increase of 75,892 electronically submitted NOAs through the ACE system and updated wage rates.

Electronic NOA Filing via ACE

Importers can submit the NOA data electronically through the Participating Government Agency (PGA) Message Set in the Automated Commercial Environment (ACE) and include an image of the product label; the ACE PGA data are automatically checked for presence, format, and validity. CBP must be in receipt of the completed paper NOA or its electronic alternative upon entry, and CBP will compare entry information with the NOA and notify EPA of discrepancies.
