Entry Suspended for Border 'Invasion' Migrants
The President suspended the entry into the United States, as of January 20, 2025, of aliens he identifies as engaged in the invasion across the southern border. That suspension remains in place until the President issues a finding that the invasion has ceased, under the authority of 8 U.S.C. 1182(f) and 8 U.S.C. 1185(a).
Asylum and INA Protections Limited for Invading Aliens
The proclamation restricts aliens engaged in the invasion from invoking provisions of the Immigration and Nationality Act that would permit continued presence in the United States, including section 208 (8 U.S.C. 1158) for asylum, on or after January 20, 2025. Those restrictions last until the President issues a finding that the invasion has ceased.
Entry Bar for Those Lacking Pre-Entry Health or Criminal Info
The proclamation states that, on or after January 20, 2025, entry is detrimental for any alien who fails to provide sufficient medical information or reliable criminal-history/background information before entering the United States. Such aliens are to be suspended from entry and restricted from INA provisions that permit continued presence, including asylum (8 U.S.C. 1158), until the President finds the invasion has ceased.
Federal Agencies Ordered to Repel, Repatriate, Remove
The Secretary of Homeland Security, in coordination with the Secretary of State and the Attorney General, is directed to take all appropriate action to repel, repatriate, or remove any alien engaged in the invasion across the southern border on or after January 20, 2025. These operational actions continue until the President issues a finding that the invasion has ceased.
