Within 60 days of January 29, 2025, the Secretary of Education must issue guidance on how States can use Federal formula funds to support K-12 educational choice programs. This guidance is meant to help states allow families more options for K-12 schooling.
Block-Grant Guidance for Low-Income Families
Within 90 days of January 29, 2025, the HHS Secretary must issue guidance on whether and how States receiving block grants for families and children, including the Child Care and Development Block Grant (CCDBG), can use them to expand educational choice for families, including private and faith-based options. This aims to open block-grant funding to educational alternatives for low-income and working families.
Priority for Education Freedom in Grants
The Secretary of Education will include 'education freedom' as a priority in discretionary grant programs, and within 90 days of January 29, 2025 the Secretary of Labor and Secretary of Education must each submit plans to evaluate and recommend using discretionary grants to expand education choice. This directs federal grant programs to favor or consider school choice initiatives.
Military Families' Use of DoD Education Funds
Within 90 days of January 29, 2025, the Secretary of Defense must review mechanisms for military-connected families to use Department of Defense funds to attend schools of their choice, and submit a plan describing steps needed to implement such mechanisms beginning in the 2025-26 school year. This is intended to expand school options for military families.
BIE-Eligible Families' Funding Options Review
Within 90 days of January 29, 2025, the Secretary of the Interior must review mechanisms for families of students eligible to attend Bureau of Indian Education (BIE) schools to use their Federal funding for educational options of their choice, and submit a plan to implement such options for the 2025-26 school year while reporting on current BIE school performance.
