Eminent Domain Risk for Landowners
If you are a landowner receiving this notice, Transwestern may seek an easement to build the compressor station. If you and the company do not agree on an easement, and the Commission approves the project, the Natural Gas Act gives the company the right to initiate condemnation (eminent domain) proceedings and a judge would determine compensation under state law.
Land Footprint and Permanent Take
Construction of the proposed facilities would disturb about 11.8 acres of land and Transwestern would maintain about 10.1 acres for permanent operation of the project. The project location is in Chaves County, New Mexico, and 16.1 percent of the proposed pipeline route would parallel existing rights-of-way.
Environmental and Cultural Resource Review
FERC staff will evaluate potential environmental effects of the WT-0 project under NEPA, including geology and soils; water resources and wetlands; vegetation and wildlife; threatened and endangered species; cultural resources; land use; socioeconomics; air quality and noise; and reliability and safety. The Commission is also initiating consultation under Section 106 with the New Mexico State Historic Preservation Office and seeking input from Indian tribes and the public.
