Federal Funds Can Be Cut From Schools
The order directs that Federal funds be rescinded from educational programs that "deprive women and girls of fair athletic opportunities." This applies to educational institutions receiving Federal funds and instructs all executive departments and agencies to review grants and, where appropriate, rescind funding for programs that fail to comply, effective immediately under the order signed February 5, 2025.
Department of Education Will Change Enforcement
The Secretary of Education is ordered to comply with the vacatur of the April 29, 2024 rule (89 FR 33474) and to take action so that that regulation does not have effect, to bring regulations and guidance into line with reserving women's sports for women, and to prioritize Title IX enforcement against institutions that require female students in the women's category to compete with males or to appear unclothed before males.
DoJ Will Support Enforcement Efforts
The order directs the Department of Justice to provide necessary resources, in accordance with law, to relevant agencies to ensure expeditious enforcement of the policy to preserve women's sports. This is intended to speed and support federal enforcement actions under the order.
International and Visa Measures to Limit Entry
The Secretary of State is ordered to rescind support for people-to-people sports exchanges that base female categories on identity rather than sex, to promote international rules ensuring women's sports are sex‑based, and, jointly with the Secretary of Homeland Security, to review and adjust U.S. admission and visa policies to prevent males seeking to participate in women's sports from entering the United States to the extent permitted by law, including pursuant to 8 U.S.C. 1182(a)(6)(C)(i).
White House to Convene Sports Stakeholders
The Assistant to the President for Domestic Policy must, within 60 days of the order, convene representatives of major athletic organizations and female athletes harmed by current policies and convene State Attorneys General to identify best practices and promote policies that reserve women's sports for women.
