FERC May Require Federal License

The Federal Energy Regulatory Commission is investigating whether the unlicensed Hopper Brook Hydroelectric Project in Bennington County, Vermont must be licensed under section 23(b)(1) of the Federal Power Act. Vermont DEC requested the determination on November 14, 2025, citing that parts of the project were built after August 26, 1935 and that it is connected to the transmission grid.
