12.71% Duty on JSC Apatit Imports

The Department of Commerce found that JSC Apatit received countervailable subsidies for January 1, 2023 through December 31, 2023 and set a net countervailable subsidy rate of 12.71 percent ad valorem for JSC Apatit (and its cross-owned affiliates). This rate is tied to entries during the period of review (Jan 1, 2023–Dec 31, 2023).

Cash Deposits Collected Starting April 17, 2026

Upon publication, Commerce will instruct U.S. Customs and Border Protection to collect cash deposits of estimated countervailing duties equal to the company-specific rate (12.71%) for JSC Apatit on shipments entered or withdrawn for consumption on or after April 17, 2026. For non-reviewed firms, CBP will continue to collect deposits at the all-others rate or the most recent company-specific rate.

Assessment of Duties on 2023 Entries

Commerce will assess countervailing duties on appropriate entries of subject merchandise for the period of review (January 1, 2023 to December 31, 2023) in accordance with the final results. Commerce intends to issue assessment instructions to U.S. Customs and Border Protection no earlier than 35 days after publication, and liquidation may be held if a timely summons is filed.
