Possible U.S. Import Ban on Crafting Machines

The Commission may order exclusion of certain crafting machines and components from entry into the United States. The ALJ's recommended determination specifically suggested a general exclusion order (GEO) for the D563 patent and limited exclusion orders (LEOs) for other patents, which would stop the covered imported articles from entering the U.S.

Cease-and-Desist Orders Could Stop Sales

The Commission could issue cease and desist orders (CDOs) requiring respondents to stop unfair acts in the importation and sale of the accused crafting machines. The ALJ recommended CDOs against certain respondents if the Commission finds a violation of section 337.

High Bond May Be Required During Review

If the Commission orders a remedy, subject articles may be allowed entry into the U.S. during the 60-day Presidential (U.S. Trade Representative) review only if entered under bond. The ALJ recommended setting the bond at 100% of the entered value of the imported articles.
