Demand-Response Opt-Out Remains

If you run a company that aggregates customers' saved electricity, FERC withdrew its rulemaking and left in place the regulation that prevents a Regional Transmission Organization or Independent System Operator from accepting bids from an aggregator that aggregates customers of utilities that distributed more than 4 million megawatt-hours in the previous fiscal year when the state prohibits those bids. The withdrawal and termination of Docket No. RM21-14-000 take effect May 21, 2026.

No Immediate Market Changes

The Commission's withdrawal becomes effective May 21, 2026, which means the current rules stay in place and the Commission states no new costs or changes from this rulemaking will occur in the near term. This decision is intended to eliminate uncertainty about whether the Commission would move forward with revising the Demand Response Opt-Out.

FERC Encourages Demand-Response Development

FERC said it recognizes the value of demand response and encourages development of demand response programs within the existing regulatory structures. If you provide demand-response services, the Commission encouraged pursuing program development consistent with current state and market rules.
