NIOSH Respiratory Toxicants Added as Criterion

FDA finalized adding a new criterion for listing chemicals: it will consider chemicals that the National Institute for Occupational Safety and Health (NIOSH) identifies as respiratory toxicants when deciding whether to add constituents to the HPHC list. This means FDA will now use NIOSH respiratory-toxicity determinations, along with EPA and ATSDR sources, to identify harmful constituents.

18 New Chemicals Added to HPHC List

The FDA is adding 18 new chemical constituents to its established list of harmful and potentially harmful constituents (HPHCs) in tobacco products and tobacco smoke. The newly listed examples include glycerol, glycidol, ethylene glycol, diethylene glycol, and propylene glycol; FDA now identifies these as harmful or potentially harmful in tobacco products and tobacco smoke.

Three Flavor Chemicals Proposed; Comments Due

FDA is proposing to add three constituents—pulegone, furfuryl alcohol, and methyl eugenol—to the HPHC list; these chemicals are often added to e-liquid formulations as flavors and may also be in cigarettes or smokeless tobacco. The Agency requests comments and scientific information on these proposed additions, with comments due by May 26, 2026.
