DEA Proposes Rescheduling to Schedule III

The Drug Enforcement Administration proposes to transfer marijuana from Schedule I to Schedule III of the Controlled Substances Act. The Department of Health and Human Services concluded marijuana has a currently accepted medical use and a potential for abuse less than substances in Schedules I and II, with possible moderate or low physical dependence or high psychological dependence.

Public Hearing: Participation Deadlines

The DEA will hold a hearing on the proposed rescheduling beginning June 29, 2026 (9 a.m. ET) and concluding not later than July 15, 2026; the hearing will recess July 3 and reconvene July 6. If you wish to participate, you must file a written notice: electronically as a PDF by 11:59 p.m. ET on May 24, 2026, or by mail postmarked on or before May 20, 2026; the notice must meet the requirements in 21 CFR 1308.44(b). DEA will notify selected participants on June 22, 2026.
