Access to HUD Shelter Based on Biological Sex

HUD proposes to replace references to "gender" and "gender identity" with "sex" (as defined by Executive Order 14168 issued January 20, 2025). If finalized, access to HUD programs and single-sex facilities (including Section 8 housing, mortgage programs, shelters for the homeless, and community development programs) would be provided in accordance with an individual's biological sex, and people who claim a different gender identity could be denied their preferred single-sex shelter.

Shelters May Require Proof of Sex

The proposed rule would allow facility providers (such as temporary or emergency shelters with shared sleeping or bathing areas) to require "reasonable assurances or evidence" to establish a person's sex. HUD says providers may set their own standards for this evidence.

Federal Funds Withheld for Non‑Compliance

The proposed Sec. 5.106(e) says state or local entities that follow conflicting local laws instead of this rule may be considered non-compliant and could face enforcement actions, including withholding or revocation of federal funds provided through HUD's Community Planning and Development (CPD) programs. HUD is also considering preempting conflicting local laws for entities receiving CPD funds.
